Acceptance of Terms
These terms, conditions, and disclaimers ("terms and conditions", "terms of service", "terms of trade", "terms"), together with our Privacy Policy, govern all supply of goods and services ("products") by Tara Willis trading as Fleurish ("Fleurish", "we", "us") to you, the purchaser of goods and services from us, including your use of the website at www.fleurishfloral.co.nz ("Website"). They are effective from June 2026 and replace all earlier Fleurish terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.By visiting the website and/or purchasing products from this website, you engage in our service and agree to be bound by the following terms and conditions.
Fleurish may amend these terms of service from time to time and any amendment will become effective immediately. You are responsible for regularly reviewing these terms and conditions. Notice of changes may be given by posting the revised terms and conditions on our website.
To make a purchase from our online shop on this website you must be 18 years of age or over.
Purchases from our online shop may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).
If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.
Seasonality, Availability, and Supply
In line with our seasonal floristry philosophy and customized approach to creating arrangements, flower varieties in the product provided may vary to those pictured. We always use the best seasonal flowers and foliage available on the day of delivery, and while we make every effort to fulfil requests for specific flowers, we may need to substitute some blooms for others of comparable value. More information about seasonal flower availability can be found here.Orders for gift items and durable products are also subject to the availability of those products on the day of delivery and may be substituted with a comparable product.
If comparable products are not available for substitution on the day of delivery, we will contact you to discuss the options that are available, which may include a partial or full refund. Please make sure that your contact information is complete and correct when you submit your order.
Floral Care
The flowers that we sell are a perishable, natural product with a lifespan that varies depending upon the variety and species. In general, you can expect that the flowers that you purchase from us will last for approximately 7 days. To maximize the lifespan of your flowers, please take the following steps at a minimum:- Trim the stems of the flowers on a 45-degree angle as soon as you receive them and place them in a clean vase filled with fresh, room temperature water. Dilute flower food in the water using the instructions on the packet to help prolong the lifespan of your flowers.
- Keep an eye on the water levels and top them up as necessary, making sure the cut ends of your stems are always in the water.
- Clean the vase and replace the water completely every two days. Trim the stems of your flowers again before placing them back in the water.
- Keep the flowers out of direct sunlight.
- Keep the flowers in a cool room but away from drafts and air conditioning.
- Remove spent and decaying flowers and foliage daily, and keep flowers away from fruit bowls and cigarette smoke.

Please be mindful that the flowers purchased via our online shop need to be cared for per the instructions above and are not suitable for use as wedding bouquets. If you would like Fleurish to provide flowers for your wedding, please get in touch.
Delivery and Delivery Charges
Prices for goods and services stated on our website are exclusive of any applicable delivery charges.We only deliver to street addresses in the Auckland region of New Zealand. The cost of delivery is as stated on our website and a total delivery cost will be provided in the order summary in your online shopping basket once you have provided delivery address details.
We deliver our products via courier Monday-Friday, excluding public holidays. As we source fresh floral products for each order placed, we do not currently offer same-day delivery.
It is your responsibility to supply the correct address and additional instructions required for delivery (such as security gate codes) when completing your online order. Any orders delivered to an incorrectly supplied delivery address will not be eligible for refund or replacement. If you have entered an incorrect delivery address please contact us as soon as possible with the correct address via email to help@fleurishfloral.co.nz.
If delivery is attempted but is unable to be completed, your items will be returned to our premises and we will contact you to arrange re-delivery or for you to collect your items. Floral product returned to us that was unable to be delivered is not eligible to be refunded and an additional delivery attempt may incur an additional charge.

Pricing
All prices are in New Zealand Dollars and are exclusive of delivery charges and Goods and Services Tax ("GST") as Fleurish is not currently required to collect GST.All prices are correct when published. We reserve the right to alter prices at any time.
An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.
Payment Processing
All payments are processed via Stripe and are subject to Stripe's terms and conditions which can be found here. Their Privacy Policy, including details around security, can be found here. When taking payment for an order over the phone, we enter your card details directly into Stripe - we do not record or store this information anywhere else.Via Stripe, we accept payments using Visa, MasterCard, and American Express credit cards. Other payment options, such as Paypal, are available in the checkout flow.
Fleurish does not accept cash payment for any goods or services.
Cancellations
If the cancellation request is made prior to the order delivery day we will accept the cancellation and give you a refund. In the case of a cancellation, we do not refund payment processing fees.We cannot cancel orders on their day of delivery as they will have already been prepared. However, we would welcome the opportunity to discuss any alternatives available to you. Please contact us as soon as possible on 0212782303.
Returns and Refunds
We stand by the quality of our flowers, and take the utmost care in selecting and preparing them and delivering them to you. If for any reason something has gone wrong, please contact us directly at help@fleurishfloral.co.nz or on 0212782303.We do not have to provide a refund if you have changed your mind about a particular purchase, so please choose carefully. However, if the products that we have supplied are faulty, we will meet our obligations under the Consumer Guarantees Act to provide a remedy.
Requests for refunds and returns must be submitted within 7 days of delivery. Floral arrangements that have not received appropriate Floral Care after delivery will not be eligible for refund or return.
In the unlikely event of the incorrect product being shipped at the fault of Fleurish, we will cover the cost of returning the shipment and sending the correct item(s).
Privacy and Confidentiality
We collect personal information from you, including information about your:
- name
- contact information
- billing and/or purchase information
We collect your personal information in order to:
- provide goods and services to you and to administer orders and payments relating to your purchases from us.
- successfully deliver goods and services that you purchase, submit enquiries about, or otherwise contract us to provide.
- send future marketing communications, if you opt in to receiving them. You may opt out at any time.
Besides our staff, we share specific pieces of this information with third parties. Specifically, we share:
- Your name, contact, and billing/purchase information with payment processors (such as Stripe) in order to process your transactions.
- Your full name with the recipient(s) of the flowers and/or gifts you send so that they know who sent them. We do not deliver orders without disclosing the full name of the sender.
Where you have provided information to us on a confidential basis, we will hold that information in confidence, except as required by law. While we take all reasonable actions to keep your information safe and secure, we cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control.
We do not store your credit card or other payment details in any form as this information is handled by our payments provider.

Liability Limitation
Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.
We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information
provided on our website.
To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.
Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.
Intellectual Property
All information, materials, and content (including but not limited to the text, layout, graphics, photography, and design) contained in this website is owned by Fleurish or is used by us with the permission of the owner.You are not permitted to reproduce the information, materials, or content on the website and nothing in these terms constitutes a transfer or licence of any of our intellectual property rights, including any intellectual property rights that we have in and to the information, material, or content that is displayed or available on the website.
Applicable Law and Jurisdiction
Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of our website or supply of any services.
Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).
You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.
General Conditions
We reserve the right to change these terms and conditions from time to time by notice, which may be in the form of a notice posted on our website at www.fleurishfloral.co.nz.If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.
If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.
Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.
We may deliver notices to you by sending them to an email address that you have supplied to us.
